New Defibrillator Warnings

Recently, the FDA warned that about 300,000 defibrillators manufactured by Cardiac Science Corporation have potential malfunctions. According to the FDA, these malfunctions don't show up on device self-tests, but may prevent delivery of life-saving shocks.

The devices affected by the warning include some Powerheart and CardioVive models of AEDs, manufactured between August 2003 and August 2009. Some of the potential problems include failure to recognize pad placement during use, interference from background noise, and interrupted electrocardiography analysis. Though the FDA is not issuing a recall of these devices, it is urging users to take certain precaution if they are currently using affected AEDs. Some of those recommendations include using an alternate AED if available, until the malfunctioning model has been replaced or repaired, for at-home use, only use the device when necessary, in clinical settings, use a manual defibrillator if available.
Originally posted at InjuryBoard by Jamie Sheller

Emergency Alert Regarding MTD Snow Throwers

Winter is quickly approaching, and snow has already fallen in parts of the country. Along with snowfall, comes the use of snow throwers. However, some snow throwers should not be used. In 2006, there was a recall of snow throwers manufactured by MTD. The snow throwers were recalled due to the risk of injury from bursting wheel rims when the tires are inflated. Exploding plastic wheel rims have caused numerous injuries, including lacerations and fractures. The snow throwers involved in the recall are two-stage compact snow throwers with Troy-Bilt, Yard Machines or Craftsman printed on the snow thrower's housing. Yard Machine and Troy-Bilt brand snow throwers were sold at independent dealers, home improvement and hardware stores. Craftsman brand snow throwers were sold at Sears and Kmart stores. Snow throwers involved in the recall were sold between July 2004 and March 2006. The MTD snow thrower recall was done in cooperation with the Consumer Product Safety Commission.

Despite the fact that the recall was done in 2006, people are still using the recalled machines, and being injured. Anyone who has one of the recalled MTD snow throwers should not try to inflate the tires. There is a risk of injury caused by the tire rim exploding.

If you have been injured by an MTD snow thrower, contact Jamie Sheller, at Sheller, P.C. to discuss your potential legal rights. The Sheller firm has a long history of successfully representing individuals and classes of individuals who have been injured by defective products.
Originally posted at InjuryBoard by Jamie Sheller

Bacteria In Vicks Nasal Spray

Vicks Sinex nasal spray has been recalled in the United States, Britain, and Germany. Proctor & Gamble announced the recall after discovering that some of the Vicks nasal spray was contaminated with bacteria. According to Proctor & Gamble, the bacteria was found during routine quality control at a manfacturing plant in Germany. The company states that, so far, the contamination is limited to a single batch of raw material mixture. Three lots of the product, sold in the United States, Britain, and Germany are affected by the recall. Proctor & Gamble asserts that the bacteria does not pose a great risk to healthy people, but that people with weakened immune systms or chronic lung conditions could develop serious sinus infections from the bacteria.

If you have the recalled Vicks nasal spray, you should discard it and contact Proctor & Gamble for a replacement coupon or refund. In the United States, the affected product is Vicks Sinex Vapospray 12-hour Decongestant Ultra Fine Mist, with lot number 9239028831.

Proctor & Gamble is based in Cincinatti, Ohio.

Public Service Alert - Strollers Recalled

The Consumer Product Safety Commission has announced a recall of about 1 million Maclaren strollers. The stroller recall came after an investigation of 12 reports of the strollers' hinge mechanism amputating the fingertips of children. Strollers affected by the recall have been sold since 1999 by Target, Babies "R" Us and other stores. The recalled Maclaren stroller models include: Volo, Triumph, Quest Sport, Quest Mod, Techno XT, Techno XLR, Twin Triumph, Twin Techno, and Easy Traveller. There is a risk of children having their fingertips amputated if their finger is placed in the Maclaren stroller's hinge mechanism while the stroller is being unfolded. The finger tip can be cut off when the stroller locks into place. To prevent future incidents, Maclaren is offering free hinge covers, which should not be removed unless the stroller is being cleaned. Parents and caregivers should immediately stop using the recalled Maclaren strollers.
Originally posted at InjuryBoard by Jamie Sheller

Strangulation Risk Leads To Recall of Window Blinds

According to the Consumer Product Safety Commission, some Roman shades and roller blinds pose a serious strangulation risk for young children. Therefore, recently there was a recall of nearly 1 million roller blinds and Roman shades sold by IKEA, Bed, Bath & Beyond and Hanover Direct.

The following models of IKEA roller blinds, sold between July 2005 and July 2008, were involved in the recall: ISDANS, TUPPLUR and ENJE. These blinds were manufactured in France and Taiwan. IKEA has been involved in 2 previous recalls of blinds, in August 2009 and November 2008, following a child's death. This current recall is not related to any reported incident involving IKEA blinds.

In addition to the IKEA blinds, Dublin Energy Solution Roman Shades, sold exclusively by Bed, Bath & Beyond have been recalled. These shades are Chinese made and were sold between August 2007 and September 2009. These shades have been involved in 2 incidents where small children became entangled in the inner cords. The two children did not receive permanent injuries in these incidents.

Also, some Roman shades sold by Hanover Direct, also known as Domestications, have been recalled. These shades are Chinese made faux suade, and were sold between January 2004 and December 2008. A small child had become entangled in the inner cord of these shades, with no permanent injury.
Originally posted at InjuryBoard by Jamie Sheller

MTD Snow Thrower Public Service Announcement

Owners of snow throwers, please read this information. This is a public service announcement re-posting information about defective MTD snow throwers sold under the Troy-Bilt, Yard Machines and Craftsman brands. Despite the fact that these defective snow throwers were recalled, people are still being injured by them. If you have one of these snow throwers, don't try to inflate the tires. The tires are defective and dangerous and should not be inflated. Attempting to inflate these tires could result in the tire exploding and causing injury. Read the information below, determine whether your snow thrower is included in the recall and take appropriate action.

Despite the fact that the CSPC and MTD announced the recall of over 130,000 snow throwers back in 2006, we are seeing that many of the recalled snow blowers are still being used.

Consumers who have not received notice of the recall or who have not returned their snow throwers are using them this winter season, and some are being injured when trying to inflate tires, which causes the plastic wheel rims to burst.

As of the original recall date of October 5th 2006, the CSPC had received reports of 16 injuries, but that number is climbing higher as consumers continue to use the snow throwers/blowers unaware of the dangers they pose.

The defective snow throwers were sold under the Troy-Bilt, Yard Machines and Craftsman brands. Consumers can find the model numbers on the rear frame to find out if they are using one of the recalled machines.

If you purchased a Troy-Bilt, Yard Machines or Craftsman snow blower / snow thrower between July 2004 and July 2006, it is important to check the model number to ensure it is not a machine that has been recalled. An exploding tire poses the threat of severe injury including, but not limited to lacerations and fractures.

Remedy: Consumers should contact MTD for a free service kit with pressure relief valves, labels and instructions. Consumers with Craftsman brand snow throwers will be mailed a service kit directly by Sears.

If you have been injured by a snow thrower tire, contact Sheller, P.C. Our lawyers have extensive experience successfully representing people who have been injured by dangerous products. We have helped many injured people obtain the compensation that they deserve from the manufacturers of defective and dangerous products.
Originally posted at InjuryBoard by Jamie Sheller

Wheel Rims Can Burst and Cause Injury on Recalled MTD Snow Throwers

In 2006 the CSPC and MTD announced a recall of around 130,000 snow throwers sold under the Troy-Bilt, Craftsman and Yard Machines brands. An issue with tire pressure resulted in some plastic wheel rims bursting and injuring consumers when the tires were overinflated.

As of the recall date, the manufacturer had received reports of 16 injuries, but we are finding that the recall notice did not reach all consumers, and many snow throwers are still in use today. Customers still using the snow throwers should contact MTD for further instructions. If you have been injured by one of these machines, it may also be important to contact an attorney and protect your legal rights.

Yahama Rhino Among Off-Road Vehicles Investigated By CPSC

The Yamaha Rhino is a popular off-road vehicle. It has reportedly been involved in many accidents, including approximately 30 deaths, including two young girls in October. The U.S. Consumer Product Safety Commission is investigating utility terrain vehicles (UTV's), including the Rhino, because of safety concerns revealed by the accidents involving the Rhino. However, the Yamaha Motor Corp., USA insists that "If you operate it carefully and use some common sense and good judgment, it's a really great product."

Due to certain design differences, UTV's are not subject to the same safety standards of either all-terrain vehicles (ATV's) or cars. In fact, UTV owners do not even have to register the vehicles, and until 2008, doors were not standard equipment on the Rhino. There currently are no regulatory standards governing UTV's, as this type of vehicle is considered and "emerging hazard area." According to Yamaha, some of the Rhino parts, such as seat belts, are in voluntary compliance with federal vehicle standards. The CPSC investigation will help determine whether UTV regulations are needed, and if so, what those regulations will look like. Some critics of the Rhino argue that certain design features of the Rhino increase the risk of tipping over, which has led to a number of accidents and injuries.

If you or someone you know has been injured in an accident involving an ATV or UTV, such as the Yamaha Rhino, contact Sheller, P.C. The lawyers at Sheller have many years of experience successfully representing people injured in vehicle accidents, including injuries caused by vehicle rollovers and design defects.

Tainted Drywall Thought To Injure Homeowners

A construction material, manufactured in China, is believed to be sickening homeowners in a number of states across the U.S. Sulfur-tainted drywall may have been installed in tens of thousands of homes, likely between 2004 - 2006. It is claimed that the defective Chinese drywall emits a foul odor and corrodes the homes' wiring. Some inhabitants claim to suffer physical ailments, such as respiratory problems, headaches and nosebleeds caused by the tainted Chinese drywall. Lawsuits have been filed in Florida against several drywall manufacturers, distributors and home-building companies, seeking compensation for personal injuries and property damage that homeowners claim are linked to the Chinese drywall. Florida health officials are trying to determine whether the drywall is a medical hazard.
Originally posted at InjuryBoard by Jamie Sheller

Treatment for Nephrogenic Systemic Fibrosis

Nephrogenic Sytemic Fibrosis (NSF) or Nephrogenic Fibrosing Dermopathy (NFD), is a disorder typically suffered by patients with kidney failure. It may cause severe skin lesions, masses on the skin and can affect the joints. There is currently no cure for Nephrogenic Systemic Fibrosis/Nephrogenic Fibrosing Dermopathy. However, early diagnosis and treatment may slow the progress of the disorder. The treatment for NSF/NFD may be done by a kidney specialist (nephrologist) and dermatologist working together. Though there is no consistently successful treatment for nephrogenic systemic fibrosis/nephrogenic fibrosing dermopathy, improving kidney function is important. NSF/NFD has been linked to gadolinium-based contrast agents used in imaging studies, such as MRI's.

Originally posted at InjuryBoard by Jamie Sheller
